Welcome to MaskHer, the AI-powered mobile application ("App") provided by MaskHer Technologies ("Company", "We", "Us", or "Our"). This User Agreement ("Agreement") governs your access to and use of the App, including its features for image face swapping, video face swapping, text-to-image generation, and in-app purchases of virtual goods. By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian.
You may not use the App if doing so is prohibited by applicable law or if your account has been suspended or terminated by Us.
2. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to this Agreement.
You may not copy, modify, distribute, reverse-engineer, or attempt to derive the source code of the App.
3. In-App Purchases and Virtual Goods
Virtual Goods: The App offers in-app purchases of virtual goods, such as premium filters, advanced editing tools, or additional text-to-image credits ("Virtual Goods"). These are digital items for use within the App only.
Non-Refundable: All purchases of Virtual Goods are final and non-refundable, except as required by applicable law or Apple’s App Store policies. You are responsible for any applicable taxes.
No Real-World Value: Virtual Goods have no monetary value outside the App and cannot be exchanged, transferred, or redeemed for cash or other consideration.
Pricing and Availability: We may change the pricing or availability of Virtual Goods at any time without notice. All payments are processed through the Apple App Store, subject to their terms.
Consent for Sharing Purchase Data: By making in-app purchases, you consent to Us sharing data about your usage of purchased Virtual Goods with Apple to process refund requests or resolve disputes, in compliance with Apple’s policies.
4. User Content and Conduct
Your Content: You may create content using the App’s features ("User Content"). You retain ownership of your User Content but grant Us a worldwide, royalty-free, non-exclusive license to use, reproduce, and distribute it solely to provide and improve the App’s functionality.
Prohibited Conduct: You agree not to:
Use the App for illegal, harmful, or offensive purposes.
Create or share User Content that is obscene, defamatory, or infringes on others’ rights (e.g., intellectual property, privacy).
Attempt to bypass or manipulate the App’s features, including in-app purchase systems.
Use the App to distribute malware or engage in unauthorized data collection.
5. Intellectual Property
All App content, including software, designs, trademarks, and AI models (excluding your User Content), is owned by Us or our licensors and protected by intellectual property laws.
You may not use our trademarks, logos, or other proprietary content without prior written consent.
6. Termination
You may stop using the App at any time by uninstalling it.
We may suspend or terminate your access to the App if you violate this Agreement, engage in prohibited conduct, or for any reason at our discretion.
Upon termination, your license to use the App ends, and any unused Virtual Goods may be forfeited without refund, except as required by law.
7. Disclaimers and Limitation of Liability
As-Is Basis: The App is provided "as is" without warranties of any kind, express or implied, including regarding functionality, accuracy, or availability.
Limitation of Liability: To the maximum extent permitted by law, We are not liable for any indirect, incidental, or consequential damages arising from your use of the App, including loss of data, profits, or Virtual Goods. Our total liability shall not exceed the amount you paid for in-app purchases in the past 12 months.
Third-Party Services: The App may integrate with third-party platforms (e.g., social media). We are not responsible for their functionality or terms.
8. Indemnification
You agree to indemnify and hold Us harmless from any claims, losses, or damages (including legal fees) arising from your use of the App, your User Content, or your violation of this Agreement.
9. Governing Law and Dispute Resolution
This Agreement is governed by the laws of [Insert Jurisdiction, e.g., California, USA], without regard to conflict of law principles.

12. Miscellaneous
Entire Agreement: This Agreement, along with any in-App terms, constitutes the entire agreement between you and Us regarding the App.
Severability: If any provision of this Agreement is found invalid, the remaining provisions remain in effect.
No Waiver: Our failure to enforce any right or provision does not waive that right or provision.
